1. Nature of Arrangement
    1. These Terms govern the provision of charitable services and donated products by RRT NZ to the recipient organisation (“Recipient”).
    2. RRT NZ is a registered New Zealand charity established for the charitable purpose of the relief of such poverty, sickness, suffering, distress, misfortune, disability, destitution or helplessness as arouses pity or compassion in the community.
    3. These Terms are intended to reflect a charitable collaboration. They are not intended to create a legally binding commercial contract but represent an expression of intention that both parties will work together in good faith so that RRT NZ’s charitable purpose is fulfilled.
  2. Definitions
    1. Red Tent Event means the provision of catering and associated volunteer support services, which may include:
      1. Cooking and serving hot or cold food and beverages;
      2. Provision of bottled water or packaged snacks;
      3. Set-up and operation of RRT trailers, tents and equipment.
    1. Product Donations may include (but are not limited to):
      1. RRT Food Boxes;
      2. Care Kits;
      3. Comfort Snack Packs;
      4. Smarrt Cookie Bars;
      5. Essentials Boxes;
      6. Any other tangible goods provided by RRT NZ.
    1. Other Contributions may include (but are not limited to):
      1. Sponsorships;
      2. Asset Donations.
    1. Services means Red Tent Events, Product Donations, and/or Other Contributions.
  3. Services Confirmation
    1. Each event, product donation, or contribution will be confirmed in writing (typically via email).
    2. Details of events and product donations will typically include:
      1. Date, time and location;
      2. Nature of support;
      3. Estimated numbers to be served;
      4. Contact persons;
      5. Whether cash or EFTPOS handling by RRT NZ is required.
    3. Either party may cancel or vary arrangements by giving reasonable notice.
    4. Details relating to other contributions will be set out in a separate Memorandum of Understanding (MoU), which complements these Terms.
  4. Cash Handling
    1. RRT NZ does not typically collect or handle cash or payments on behalf of a recipient organisation. Where the Recipient wishes to collect donations independently, this remains their responsibility and is separate from any RRT NZ activities.
    2. Where cash or EFTPOS payments are to be collected by RRT NZ as part of an event or service, this must be agreed in advance and confirmed in writing.
    3. In such cases, RRT NZ’s internal cash handling procedures will apply, including requirements relating to the collection, reconciliation, and banking of funds.
    4. The Recipient acknowledges that:
      1. any funds collected by RRT NZ will be managed in accordance with RRT NZ processes and legal obligations (including GST requirements), and
      2. any arrangement involving the collection of funds must be clearly agreed prior to the event.
  5. Health & Safety
    1. RRT NZ operates as a Person Conducting a Business or Undertaking (PCBU) under the Health and Safety at Work Act 2015 and is committed to providing a safe environment for volunteers, recipients, and members of the public.
    2. RRT NZ will:
      1. Manage food safety and hygiene in accordance with applicable New Zealand food safety requirements;
      2. Maintain equipment and trailers to appropriate safety standards;
      3. Provide inducted and appropriately trained volunteers.
    3. The Recipient agrees to:
      1. Provide a safe and suitable site for the event;
      2. Notify RRT NZ of known hazards;
      3. Comply with reasonable health and safety instructions provided by RRT NZ.
    4. RRT NZ accepts responsibility for food sourced and prepared by RRT NZ up to the point when custody of the food or donated product passes to the Recipient.
  6. Use of Donated Products and Goods
    1. Donated items must be distributed free of charge to people in need.
    2. Products (e.g., Food Boxes) should be distributed in full and not separated into component parts unless otherwise agreed in writing.
    3. Products must not be resold, rebranded, or used for commercial gain.
  7. Privacy and Personal Information
    1. Both parties agree to comply with the Privacy Act 2020 (NZ).
    2. Personal information of beneficiaries must not be disclosed publicly without lawful authority or consent.
    3. Any exchange of reporting information between the parties should, wherever practicable, be de-identified.
  8. Photography, Video & Media
    1. RRT NZ may take photographs or video recordings of services for charitable, promotional, reporting, and fundraising purposes.
    2. Images and footage may be used in:
      1. Print publications;
      2. RRT NZ website;
      3. Social media platforms;
      4. Newsletters;
      5. Annual reports;
      6. Presentations and funding reports.
    3. RRT NZ will not intentionally identify individuals by name without consent.
    4. Event attendees who do not wish to be photographed should make this known to the photographer or the RRT Event Team Leader at the time of the event.
    5. Where children or vulnerable persons are present, reasonable efforts will be made to ensure appropriate consent processes are followed.
    6. The Recipient acknowledges that RRT NZ may publish details including:
      1. The purpose of the event, donation, or contribution;
      2. A summary of the service provided;
      3. The number of meals or products provided;
      4. Testimonials;
      5. Funds raised (if applicable);
      6. Attendance of public figures.
    7. The Recipient may use images including RRT branding only in a manner consistent with RRT NZ’s brand integrity and not in a misleading or deceptive way.
  9. Public Statements & Branding
    1. Neither party will publish details of the Services or make public statements that misrepresent the nature of the support provided.
    2. The RRT name, logo, and branding must not be used beyond reasonable reporting of the event without prior permission.
  10. Amendments

    RRT NZ may update these Terms from time to time. The version current at the time the Services are provided will apply.
